Why the skill, chance distinction matters
Almost every gambling law in Asia starts from the same idea: if a game depends mostly on skill, it is not gambling, and if it depends mostly on chance, it is. That single line decides whether you can sit down and play for money, whether an operator needs a license, and whether a payment can legally be processed.
The line is not always obvious. Slot machines are the clearest case on the chance side. Most slot play is purely luck, and even on machines where a bonus game lets you influence the outcome through arcade-style interaction, the random number generator usually decides whether you reach the bonus and how much money is available to win, so luck stays dominant8. On the skill side, poker is described as a skill-based game in which chance and strategy both influence your outcome9. Fortune pai gow poker sits in between: it is considered a game of skill, and learning the optimal strategy improves your odds, but the result still depends greatly on chance10.
The same game can land on different sides depending on the format. Five-card draw poker is more a chance game than skill, unlike Texas Hold'em11. Mississippi Stud involves some skill in deciding whether to bet or fold, but it is a game of chance based on the random distribution of cards12. So the question is never just "is poker skill?" It is "which poker, played how?"
For you as a player, the practical effect is simple. If a game is classified as skill, you can usually play it for money in places that exempt skill games, and operators can offer it. If it is classified as chance, it falls under the gambling acts and is largely prohibited, with licensed casino gaming allowed in Goa and Sikkim3. If you want the wider picture of how these rules differ across the region, see Gambling Laws in Asia: What Is Legal in 12 Jurisdictions.
What counts as a game of skill
A game of skill is one where your decisions, not the deal, decide the outcome. Under Indian law the test is preponderance: a game counts as one of mere skill when skill outweighs chance, and games of mere skill do not amount to gambling and can be treated as commercial activities13. That is the standard courts have applied for decades.

Rummy is the classic example. It is described as mainly and preponderantly a game of skill, not a game of entire chance14. Indian Rummy is classified as a game of skill15, and operators describe online rummy as fully legal and entirely skill based16. Poker follows the same path, and fantasy sports were built on the same argument.
Horse racing is the other long-standing skill category. Betting on horse racing is considered a game of skill rather than chance, a classification supported by the Supreme Court of India, and a license is typically required where it is permitted under state law1. Indian courts have defined betting on horse racing as a game of skill, though the laws vary from state to state13.
The practical consequence is that skill games are excluded from the gambling acts in most states. The exclusion applies everywhere except Assam, Odisha, Andhra Pradesh, Tamil Nadu and Telangana3. A licensee holding a Nagaland Act license is allowed to offer games of skill across India, in states where such games are not classified as games of chance and where an exception for games of skill exists3. If you want to know how paid fantasy contests fit this picture, Is Paid Fantasy Sports Legal in Asia? covers it.
What counts as a game of chance
A game of chance is one where a random event decides the result, even if you make choices along the way. Mississippi Stud is the clean illustration: you decide whether to bet or fold, but the cards come at random, so it is a game of chance12. Slot machines are the same story, with the random number generator controlling whether you reach a bonus and how much is available to win8.
Games of chance for stakes fall within the ambit of the state gambling acts and are largely prohibited, with licensed casino gaming allowed in Goa and Sikkim3. That is why the distinction matters so much in India: the same country that lets you play rummy for money in most states will not let you play a card game that is mostly luck.
The dividing line is not about how complicated a game looks. Five-card draw poker has strategy in it, but it is more a chance game than skill, unlike Texas Hold'em11. Fortune pai gow poker rewards optimal strategy but still depends greatly on chance10. A game can have skill in it and still be classified as chance if the random element dominates.
India: courts have called rummy and poker games of skill
India's courts spent years drawing the skill line, and the results still shape what people believe is allowed. In 2015 the Supreme Court declared playing rummy and other card games online to be legal and beyond the ambit of gambling17. The high courts of Karnataka and Andhra Pradesh had already found rummy to be a game of skill and not illegal17.
The legal foundation is old. The Public Gambling Act of 1867 exempted games of skill from the definition of gambling, which led courts to protect rummy and later fantasy sports as legal18. At the central government level, online skill gaming is legal, and the Supreme Court has recognized rummy and some other games as games of skill, though it has not ruled on poker or fantasy sports under that 1867 Act18.
The practical picture that emerged was narrow but real. The only legal forms of gambling in India were state-run lotteries in some states only, horse racing, rummy card games and casinos in two states19. Rummy was declared a game of skill by courts and excluded from laws banning betting and gambling in all states except a few20.
That is the background you need to understand why so many people still believe online rummy and poker are fine. For years, in most states, they were. The change came in 2025, and it did not turn on skill at all.
India's online money game ban covers skill, chance, or both
India's online gaming law ended the skill argument for paid online play. The Act imposes a complete ban on all forms of online money games, and this applies to games of chance, games of skill, and any mix of the two, along with their advertising, promotion and facilitation4. The operative wording is blunt: no person shall offer, aid, abet, induce or otherwise indulge or engage in the offering of an online money game or online money gaming service5.

Section 5 of the law prohibits every online money game, whether based on skill, chance or both22. Banks and payment systems are barred from processing those transactions22. The law also places stronger emphasis on consumer protection, responsible gaming and harm prevention23.
The result is that India now has one of the most restrictive regimes globally, banning both skill and chance-based money games18. The old skill exemption that protected rummy and fantasy sports no longer decides anything for online play. If you want the country-level view, Can I Gamble in India? sets out what remains available.
What counts as an online money game is defined broadly. It is an online game where a user makes a deposit in cash or kind with the expectation of earning winnings on that deposit24. The Act prohibits online games involving monetary stakes or winnings regardless of whether the underlying game is one of skill or chance, and e-sports are excluded from the definition1. So competitive video gaming without money stakes sits outside the ban, while a paid rummy or fantasy contest does not.
Online real-money gaming has been banned across India since May 1, 2026, under a government order dated April 22, 20266. Tamil Nadu and Kerala had already moved to partial bans, with some formats banned and the rules changing26. If you are trying to work out whether a site you have used is caught, Is It Illegal to Use Offshore Gambling Sites in Asia? deals with that question directly.
What the ban does not penalize: the player
The published rules target the supply side. The prohibition is on offering, aiding, abetting, inducing or engaging in the offering of an online money game and online money gaming service5. Banks and payment systems are barred from processing the transactions22. The emphasis on consumer protection and harm prevention points the same way23.
That does not mean there is no player-side risk anywhere in Asia. Singapore is the clearest example of a jurisdiction that does penalize the individual: a person who plays a game of chance on a prohibited or unapproved gaming machine can be fined up to S$10,000, imprisoned for up to 6 months, or both7. The rule applies to the player, not just the operator.
So the practical answer depends on where you are. In India, the enforcement machinery described in the law is aimed at operators and payment channels. In Singapore, the player can be the one charged. If you want the full comparison of what players face across the region, Penalties for Gambling in Asia: What Players Face lays it out.
Gray areas: Assam and Odisha
The skill exemption was never nationwide. Games of skill are excluded from the gambling acts in most states, but not in Assam, Odisha, Andhra Pradesh, Tamil Nadu and Telangana3. In Assam, Odisha and Telangana, you cannot play a game of skill for money, which made premium fantasy sports illegal there27.
Rummy is the sharpest example of the gray area. In Assam and Odisha the skill exemption does not apply, so games of skill cannot be played for money there18. So even before the 2025 ban, a player in Guwahati or Bhubaneswar could not rely on the skill argument that worked in Mumbai or Bengaluru.
The practical takeaway is that state lines mattered, and in a few states they still shape what is offered. A Nagaland licensee could offer games of skill across India only in states where such games are not classified as games of chance and where a skill exception exists3. Assam and Odisha were outside that map. For the wider regional picture on paid contests, Is Paid Fantasy Sports Legal in Asia? is the place to look.
How regulators decide: the preponderance test
When a regulator or court has to classify a game, the working test is preponderance. A game of mere skill is one where skill preponderates over chance, and such games do not amount to gambling and can be considered commercial activities13. It is not a test of whether skill exists at all. It is a test of which element dominates.
That is why the same family of games splits:
- Rummy is mainly and preponderantly a game of skill14.
- Five-card draw poker is more a chance game than skill, unlike Texas Hold'em11.
- Fortune pai gow poker is a game of skill where optimal strategy improves your odds, but chance still matters greatly10.
- Mississippi Stud has skill in the betting decision but is a game of chance based on random cards12.
| Game | Skill or chance | Where it stands |
|---|---|---|
| Rummy | Skill | Excluded from gambling acts in most Indian states, but banned online for money since May 20263 |
| Poker (Texas Hold'em style) | Skill | Classified as a skill game by Indian courts, but online money play is banned26 |
| Five-card draw poker | Chance | More a chance game than skill11 |
| Fantasy sports | Skill | Protected as skill before 2025, now inside the online money game ban18 |
| Horse racing betting | Skill | Legal where licensed under state law1 |
| Mississippi Stud | Chance | Game of chance based on random cards12 |
| Slots | Chance | Random number generator controls the outcome8 |
The test also explains why the 2025 Indian law was written the way it was. Rather than argue about preponderance game by game, it bans online money games whether they rest on skill, chance or both4. The classification question that once decided everything now decides nothing for paid online play in India.
For players elsewhere in Asia, the old test still does the work. If you are checking whether a specific game is treated as gambling where you are, What Counts as Gambling Under Asian Law? walks through the definitions, and Is Online Gambling Legal in Asia? The 12 Jurisdictions Compared shows how each country applies them.
Common Questions
Is rummy legal in India?
Rummy has long been treated as a game of skill, and courts in Karnataka and Andhra Pradesh ruled it was not illegal. But since May 1, 2026, playing rummy online for money is banned nationwide under the 2025 online gaming law, so the old skill ruling no longer protects paid online play.
Is poker a game of skill or gambling in India?
Poker is generally described as a skill-based game where chance and strategy both shape the outcome, but the Supreme Court has not ruled on poker under the Public Gambling Act of 1867. Either way, online poker for money is prohibited by the 2025 Act.
Are fantasy sports gambling under Indian law?
Fantasy sports were treated as games of skill, not gambling, and were protected on that basis. The 2025 online gaming law now bans online money games whether they rest on skill or chance, so paid fantasy contests fall inside the ban.
When did India's online gaming ban take effect?
Online real-money gaming has been banned across India since May 1, 2026. The date was set by a government order dated April 22, 2026, which appointed the effective date for the online gaming law passed in 2025.
Can I be fined for playing an online money game in India?
The 2025 law targets the people who offer, promote or facilitate online money games, and banks and payment systems are barred from processing those transactions. The published rules focus on operators and payment channels rather than penalizing the individual player.
What makes a game an 'online money game' under the 2025 Act?
It is an online game played for monetary stakes or winnings, whether the underlying game is one of skill, chance or a mix of both. E-sports are excluded from the definition, so competitive video gaming without money stakes sits outside the ban.
Is online rummy legal in Assam and Odisha?
No. Assam and Odisha have not recognized the skill exemption that most other states apply, so games of skill cannot be played for money there. Paid online rummy is not available to players in those two states.
