India's Enforcement Directorate filed a prosecution complaint against Future Gaming and Hotel Services and 15 other companies affiliated with its managing director, lottery magnate Santiago Martin, under the Prevention of Money Laundering Act, 2002. The complaint was filed before the PMLA Court in Kolkata on September 9, 20231.

The agency had earlier attached ₹411 crore in the bank accounts of the firm and other companies in March 20221. The directorate alleged the companies "have allegedly cheated the lottery issuing state governments by not depositing the entire sale proceeds generated from the sale of lotteries," and violated the lottery law by illegally retaining and claiming prizes on unsold tickets, and manipulating data2.

Martin and his firm have denied wrongdoing. His conglomerate, Martin Group, said in October the group and its firms obey the law and that Martin was India's highest taxpayer in the financial year to March 20032. His appeals against property seizures by the Enforcement Directorate were dismissed last year2.

The complaint is one strand of a longer record. Martin and his affiliates faced fraud allegations in 32 lottery scandal cases registered by India's federal police, including for allegedly defrauding the northeastern state of Sikkim of more than 45 billion rupees in unpaid lottery ticket proceeds2. He was jailed with several politicians for eight months in connection with 14 cases, including charges of land-grabbing, cheating and illegal lottery sales. He has not been convicted in any of the cases, some of which are still pending, and was released on bail in 20122.

Separately, data released by the Election Commission of India on the orders of the Supreme Court showed Future Gaming and Hotel Services was the largest political donor for the period April 12, 2019 to January 24, 2024, donating a cumulative ₹1,368 crore in electoral bonds1. The State Bank of India disclosed the information on March 121. The Supreme Court found the "electoral bonds" system unconstitutional; it had allowed anonymous and unlimited donations to political parties2. Prime Minister Narendra Modi's Bharatiya Janata Party was the biggest overall recipient, but the data does not detail which party any donor gave to2. There was no suggestion that donations were improper2.

What it means for players

Lotteries in India are run by state governments, and the rules on which lotteries are legal, who may sell tickets and where they may be sold vary by state. The allegations here concern the operators' dealings with issuing state governments, not the act of buying a ticket. The case is a criminal prosecution complaint, not a conviction, and Martin has not been convicted in any of the cases, some of which are still pending2. Players in states that source tickets through Martin-affiliated distributors have no reported change to ticket sales or prize claims from this filing. Anyone checking whether a particular lottery is state-authorized can see where gambling is permitted under India's state-by-state rules and the wider gambling laws in Asia.

What happens next

The complaint was filed before the PMLA Court in Kolkata on September 9, 20231. The sources do not report a hearing date, a trial schedule or any ruling on the complaint. The status of the 32 federal police lottery cases and the 14 cases in which Martin was jailed is not reported beyond the statement that some remain pending2.
