Singapore's Ministry of Home Affairs introduced the Gambling Regulatory Authority of Singapore Bill and the Gambling Control Bill for First Reading in Parliament on 14 February 20221. The GRA Bill reconstitutes the Casino Regulatory Authority as the Gambling Regulatory Authority, which will regulate the entire gambling landscape, while the Gambling Control Bill updates gambling laws and regulatory approaches1. The Gambling Control Bill was published in the Government Gazette the same day and read the first time on 14 February 20222.

The GRA Bill establishes the GRA as the single regulator for all forms of gambling, consolidating functions now split among the Casino Regulatory Authority, an MHA unit covering online gambling and fruit machines, the Singapore Totalisator Board and the police1. The government aims to establish the GRA in mid-20221. The Gambling Control Bill repeals the Betting Act 1960, the Common Gaming Houses Act 1961, the Private Lotteries Act 2011 and the Remote Gambling Act 2014, and amends the Casino Control Act 20062. A separate Casino Control (Amendment) Bill will be tabled on a later date1.

The Gambling Control Bill makes the definition of gambling technology-neutral, so betting covers the outcome of any competition, event or process, while financial products regulated by the Monetary Authority of Singapore are excluded1. It provides an exemption for social gambling among family and friends in homes, but not online, because MHA said it would be difficult to establish if individuals are sufficiently and meaningfully acquainted online1. It also criminalizes proxy gambling in casinos and fruit machine rooms, where someone inside a gambling area acts on the instruction of a decision maker outside it1.

Penalties are set in a three-tier structure, with the highest penalties for operators, then agents, then punters1. A punter who gambles with an unlicensed gambling service could be jailed for up to six months, fined a maximum of S$10,000, or both, up from a maximum fine of S$5,000 and/or six months' jail under current law5. An operator conducting unlawful betting operations, gaming or lotteries could be jailed for up to seven years and fined a maximum of S$500,000, with repeat offenders facing up to 10 years' jail and a maximum fine of S$700,0005. Mandatory imprisonment applies to agents and operators of unlawful gambling activities1.

OffencePenalty under the Bill
Punter gambling with unlicensed serviceUp to 6 months' jail, fine up to S$10,000, or both5
Operator of unlawful betting, gaming or lotteriesUp to 7 years' jail and fine up to S$500,0005
Repeat operator or facilitatorUp to 10 years' jail and fine up to S$700,0005

The minimum age for gambling remains 21, except at Singapore Pools' physical outlets, which stays at 181. It becomes a criminal offense for underaged individuals to gamble or enter gambling areas, except where entry checks are not required, such as Singapore Pools' physical outlets1. Offenses also apply to excluded individuals, including undischarged bankrupts and those receiving government financial assistance, across all platforms and locations where National Council on Problem Gambling exclusions apply1. The Ministry of Social and Family Development said it will extend the exclusion program to all tenants and occupiers on the Public Rental Scheme, from June 1, and that private clubs operating fruit machine rooms must, from Nov 1, 2022, educate patrons about responsible gambling, problem gambling and help services5.

What it means for players

The bills do not change the minimum age for most gambling: 21 stays, and Singapore Pools' physical outlets stay at 181. What changes is that underage gambling and entering gambling areas become offenses in themselves, and operators that deal with underage or excluded individuals face offenses or disciplinary action by the GRA1. Excluded individuals, including undischarged bankrupts and people receiving certain government assistance, will be barred from gambling and from entering gambling areas across all platforms and locations where NCPG exclusions apply, not just casinos1. Proxy gambling, where someone places bets inside a casino or fruit machine room on the instruction of a person outside, becomes a criminal offense1. Social gambling at home among family and friends is exempted, but online social gambling is not1. Penalties for betting with an unlicensed operator rise, with a maximum fine of S$10,000 and up to six months' jail5. The Singapore guide and the page on which gambling operators are licensed in Singapore cover the current licensing position, and gambling help and self-exclusion in Singapore explains the exclusion system.

What happens next

The bills were introduced for First Reading on 14 February 2022 and require further parliamentary stages before becoming law1. The Gambling Control Act 2022 comes into operation on a date the Minister appoints by notification in the Gazette2. The government aims to establish the GRA in mid-20221. The Casino Control (Amendment) Bill will be tabled on a later date, with more details released in due course1. Details of conditions for each class-licensed activity will be released when the relevant subsidiary legislation is ready1.
