China's Supreme People's Court on 21 January 2025 published six typical cases on the punishment of gambling and related crimes, including one involving a group that organized mainland residents to gamble in Macau1. The court said the group's accounts took in more than CNY 300 million in gambling funds up to the time the case was discovered in August 20221.

In the case, Wu Moubin opened a gambling account at a Macau casino in 2005 and received rebates from the casino based on the amount of gambling funds1. Wu and others recruited mainland citizens to gamble in Macau over a long period, through in-person solicitation, telephone invitations and word of mouth, and provided services including accompaniment while gambling, settlement and logistics1. The court said the group's activities caused a large outflow of funds1.

Wu was sentenced to six years in prison and a fine for the crime of organizing participation in gambling outside the country or region1. Other defendants received sentences of between three years and two years and six months, plus fines1. The court said most of the crimes took place before Amendment (XI) to China's Criminal Law in March 2021, and this was taken into account in sentencing1. The case was heard at first instance by Ningxiang City People's Court in Hunan province and on appeal by Changsha Intermediate People's Court, and the judgment is now effective1.

The court described the wider pattern in its summary of the case:

"近年来,境外赌场对我国公民招赌、吸赌问题日益突出,催生相关专业化犯罪团伙,以旅游等名义组织赌客出境赌博,提供陪赌、结算、后勤保障等'全包式'服务,逐渐形成赌博活动跨境化、行为类型多样化、赌资外流隐蔽化等特点。"

The same release covered five other cases. A murder case in Guangxi arose from gambling debts, and the defendant was executed1.

What it means for players

The case concerns organizing mainland residents to gamble outside mainland China, which Chinese courts treat as a serious offense1. For people in mainland China, joining a group that arranges trips to Macau for gambling, or acting as an agent or recruiter for one, falls within the conduct the court punished here1. The court's summary states that overseas casinos recruiting Chinese citizens has become a prominent problem and that such groups offer all-inclusive services under the label of tourism1.

For visitors and expats in Macau, the case does not change the rules on gambling inside Macau itself, which is regulated locally. It concerns the mainland-side offense of organizing participation in gambling outside the mainland. Details of how the group's accounts were operated, and whether any players were themselves investigated, have not been reported1.

What happens next

The judgment in the Wu Moubin case is already effective, and the sentences have been handed down1. No further steps in this case have been reported1.
